These Terms and Conditions (hereinafter the \u201cTerms\u201d) regulate the relationship between eTespi O\u00dc<\/span><span style=\"font-weight: 400;\">, registration code 17507890<\/span><span style=\"font-weight: 400;\">, address T\u00e4hesaju tee 23, Lasnam\u00e4e linnaosa, 13917 Tallinn, Harju maakond<\/span><span style=\"font-weight: 400;\"> (edaspidi \u201eM\u00fc\u00fcja\u201c)and the user of the online store located at <a href=\"https:\/\/etespi.ee\/en\/\">etespi.ee<\/a><\/span><span style=\"font-weight: 400;\"> (hereinafter the \u201cSite\u201d, \u201cOnline Store\u201d, \u201cUser\u201d, \u201cBuyer\u201d).<\/span><\/p><p><span style=\"font-weight: 400;\">1.2. These Terms are drafted in accordance with the legislation of the Republic of Estonia, including:<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 Law of Obligations Act (V\u00d5S);<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 Consumer Protection Act;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 Accounting Act;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 Electronic Communications Act;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 General Data Protection Regulation (GDPR);<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 EU e-Commerce Directive 2000\/31\/EC.<\/span><\/p><p><span style=\"font-weight: 400;\">1.3. Use of the Online Store<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67f8793 elementor-widget elementor-widget-text-editor\" data-id=\"67f8793\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">3.1. The User undertakes to use the Site in accordance with the laws of Estonia and these Terms.<\/span><\/p><p><span style=\"font-weight: 400;\">3.2. The User is prohibited from:<\/span><br\/> <span style=\"font-weight: 400;\">\u2013 interfering with the operation of the Site or disrupting its functionality;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 attempting to gain unauthorised access to systems or data;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 using the content of the Site without the Seller\u2019s permission;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 providing false, incomplete or misleading information.<\/span><\/p><p><span style=\"font-weight: 400;\">3.3. The content of the Site (texts, design, images, logos, etc.) is protected by copyright and related rights and belongs to the Seller or its partners.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1742154 e-con-full e-flex e-con e-child\" data-id=\"1742154\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3ec30d3 elementor-widget elementor-widget-text-editor\" data-id=\"3ec30d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>4. Prices and Payment<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd2112a elementor-widget elementor-widget-text-editor\" data-id=\"cd2112a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">4.1. All prices in the Online Store are displayed in euros (\u20ac) and include VAT.<\/span><\/p><p><span style=\"font-weight: 400;\">4.2. The Seller has the right to unilaterally change prices and sales conditions. Such changes do not apply to orders that have already been paid. <\/span><\/p><p><span style=\"font-weight: 400;\">4.3. Online bank payments in the webshop are processed through the payment intermediary Maksekeskus AS. Maksekeskus AS processes payments securely and ensures payment forwarding in accordance with applicable requirements. Maksekeskus terms can be found at: <a class=\"decorated-link cursor-pointer\" target=\"_new\" rel=\"noopener\" data-start=\"542\" data-end=\"581\">https:\/\/makecommerce.net\/ee\/tingimused\/<\/a>  <\/span><\/p><p><span style=\"font-weight: 400;\">4.4. The Seller does not process or store the Buyer\u2019s card data; such data is processed by secure payment service providers in compliance with their terms and standards (including PCI-DSS).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3e99836 e-con-full e-flex e-con e-child\" data-id=\"3e99836\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-13eea3c elementor-widget elementor-widget-text-editor\" data-id=\"13eea3c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>5. Placing an Order and Conclusion of the Contract<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe84ae2 elementor-widget elementor-widget-text-editor\" data-id=\"fe84ae2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">5.1. To place an order, the Buyer selects the desired product, adds it to the shopping cart, fills in the required information, and confirms the order.<\/span><\/p>\n<p>5.2. An order may be placed in the online store if the total value of the goods is at least \u20ac20. Delivery charges are not included in the minimum order amount. <\/p><p><span style=\"font-weight: 400;\">5.3. The contract of sale between the Buyer and the Seller is deemed concluded under V\u00d5S \u00a7 208 when:<\/span><br\/><span style=\"font-weight: 400;\">\u2013 the Buyer has submitted the order via the Site; and<\/span><br\/>\u2013 the Seller has received confirmation of payment.<\/p>\n<p>5.4. The Seller has the right to refuse or cancel an order if:<br\/><span style=\"font-weight: 400;\">\u2013 the product is out of stock;<\/span><br\/><span style=\"font-weight: 400;\">\u2013 the Site displayed an incorrect price or other significant error;<\/span><br\/><span style=\"font-weight: 400;\">\u2013 the Buyer\u2019s information is incomplete or inaccurate;<\/span><br\/><span style=\"font-weight: 400;\">\u2013 any other grounds arise as provided by law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In such cases, the amount paid will be refunded to the Buyer.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9c93ac6 e-con-full e-flex e-con e-child\" data-id=\"9c93ac6\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7e6d8bc elementor-widget elementor-widget-text-editor\" data-id=\"7e6d8bc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>6. Delivery of Goods<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f20e6a elementor-widget elementor-widget-text-editor\" data-id=\"8f20e6a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">6.1. Delivery is carried out according to the delivery method selected by the buyer when placing the order: either self-pickup or via Venipak courier service.<\/span><\/p><p><span style=\"font-weight: 400;\">6.2. The delivery time depends on the collection\/delivery method selected by the buyer. If the buyer chooses Venipak courier service, delivery usually takes place within 3\u20135 business days. If the buyer chooses self-pickup, the order is usually ready for collection within 1\u20132 business days.  <\/span><\/p><p><span style=\"font-weight: 400;\">6.3. The Seller will make reasonable efforts to comply with the indicated delivery times, but is not liable for delays caused by transport companies or circumstances beyond the Seller\u2019s control.<\/span><\/p><p>6.4. <span style=\"font-weight: 400;\">According to V\u00d5S \u00a7 226<\/span>, <b>the risk of accidental loss or damage to the goods transfers to the Buyer only at the moment when the Buyer actually receives the goods<\/b><span style=\"font-weight: 400;\"> (e.g. from a parcel machine or a courier).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-d8e0227 e-con-full e-flex e-con e-child\" data-id=\"d8e0227\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-05efb18 elementor-widget elementor-widget-text-editor\" data-id=\"05efb18\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>7. Right of Withdrawal \u2014 14 Days (V\u00d5S \u00a7 56\u201367)<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-805a476 elementor-widget elementor-widget-text-editor\" data-id=\"805a476\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">7.1. If the Buyer is a consumer (a natural person purchasing goods outside business activities), they have the right to withdraw from the sales contract within 14 days from receiving the goods.<\/span><\/p><p><span style=\"font-weight: 400;\">7.2. To exercise the right of withdrawal, the Buyer must:<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 send a written notice to the Seller at <a href=\"mailto:info@etespi.ee\"><span class=\"elementor-icon-list-text\">info@etespi.ee<\/span><\/a>,<\/span> <span style=\"font-weight: 400;\">or use the form provided on the Site (if available);<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 return the goods within 14 days from sending the withdrawal notice.<\/span><\/p><p><span style=\"font-weight: 400;\">7.3. Returned goods must be:<\/span><br\/> \u2013 unused;<br\/><span style=\"font-weight: 400;\"> \u2013 in the original packaging (to a reasonable extent);<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 undamaged and without unnecessary signs of wear.<\/span><\/p><p><span style=\"font-weight: 400;\">7.4. The direct cost of returning the goods shall be borne by the Buyer, unless the goods were defective or unless otherwise required by law (V\u00d5S \u00a7 194).<\/span><\/p><p><span style=\"font-weight: 400;\">7.5. The Seller will refund the purchase amount (including the cost of standard delivery, if paid) within 14 days from receipt of the withdrawal notice. The Seller may withhold the refund until the goods have been returned or until the Buyer provides proof of return. <\/span><\/p><p><span style=\"font-weight: 400;\">7.6. The right of withdrawal does not apply to, among others:<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 goods made to the Buyer\u2019s specifications or clearly personalised;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 hygiene products with opened packaging where the seal protects health;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 perishable goods;<\/span><br\/><span style=\"font-weight: 400;\"> \u2013 other exceptions provided by law.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5663cc4 e-con-full e-flex e-con e-child\" data-id=\"5663cc4\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-21fabde elementor-widget elementor-widget-text-editor\" data-id=\"21fabde\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>8. Claims and Liability (V\u00d5S \u00a7 218\u2013222)<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4912cef elementor-widget elementor-widget-text-editor\" data-id=\"4912cef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">8.1. A 2-year claim period applies to goods from the moment they are handed over to the Buyer.<\/span><\/p><p><span style=\"font-weight: 400;\">8.2. During the first 6 months, it is presumed that any defect already existed at the time of delivery (V\u00d5S \u00a7 220). After 6 months, the Buyer must prove that the defect existed at delivery. <\/span><\/p><p><span style=\"font-weight: 400;\">8.3. Claims must be submitted in writing to [E-mail] <span class=\"elementor-icon-list-text\"><a href=\"mailto:info@etespi.ee\">info@etespi.ee<\/a><\/span><\/span> <span style=\"font-weight: 400;\">and include:<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 Buyer\u2019s contact details;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 description of the defect;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 photos or other evidence, if possible;<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"> \u2013 order number and purchase date.<\/span><\/p><p><span style=\"font-weight: 400;\">8.4. The Seller is responsible only for manufacturing defects and hidden defects and is not responsible for:<\/span><span style=\"font-weight: 400;\"><br\/><\/span><span style=\"font-weight: 400;\">\u2013 damage caused by improper use;<\/span><span style=\"font-weight: 400;\"><br\/><\/span><span style=\"font-weight: 400;\">\u2013 normal wear and tear;<\/span><span style=\"font-weight: 400;\"><br\/><\/span><span style=\"font-weight: 400;\">\u2013 damage resulting from failure to follow instructions.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b1fa391 e-con-full e-flex e-con e-child\" data-id=\"b1fa391\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9105584 elementor-widget elementor-widget-text-editor\" data-id=\"9105584\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>9. Processing of Personal Data<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79511d4 elementor-widget elementor-widget-text-editor\" data-id=\"79511d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">9.1. The Buyer\u2019s personal data is processed by the Seller in accordance with the Privacy Policy published on the Site and applicable legislation.<\/span><\/p><p><span style=\"font-weight: 400;\">9.2. Personal data is used for order fulfilment, delivery, invoicing, compliance with legal obligations, and \u2014 with the Buyer\u2019s explicit consent \u2014 for marketing communications.<\/span><\/p><p><span style=\"font-weight: 400;\">9.3. Marketing messages are sent only with explicit consent, which can be withdrawn at any time via the \u201cUnsubscribe\u201d link or by contacting the Seller.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-0c36d9d e-con-full e-flex e-con e-child\" data-id=\"0c36d9d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ec20bd4 elementor-widget elementor-widget-text-editor\" data-id=\"ec20bd4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4><b>10. Dispute Resolution<\/b><\/h4>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f7b3825 elementor-widget elementor-widget-text-editor\" data-id=\"f7b3825\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">10.1. Disputes between the Buyer and the Seller shall first be resolved through negotiations.<\/span><\/p><p><span style=\"font-weight: 400;\">10.2.
